In short: The Government's response to A Fairer Pathway to Settlement (Command Paper CP 1707, November 2026) replaces automatic 5-year settlement with four distinct pathways: 3, 5, 10, and 20 years. For Skilled Workers, earning at least £50,271 in 3 of the 5 years before applying—or working in an eligible Annex C public service role—unlocks the 5-year route. Otherwise, the new default is 10 years.
Current Status: This response sets out confirmed Government policy following the consultation, not yet enacted Immigration Rules. Further guidance and a formal Statement of Changes will be laid before Parliament prior to commencement. Until that takes effect, the rules in force on the date you apply govern your application.
The Four Pathways at a Glance
Skilled Worker is designated in the Command Paper as both a "core permission" and "high talent permission" route—meaning time spent on a Skilled Worker visa continues to count toward settlement.
| Pathway | Who It Is For | Core Earnings / Route Requirement | Disqualifiers (Last 5 Years) |
|---|---|---|---|
| 3 Years | Exceptional economic contribution or Highest Talent Group | £125,141+ in 3 of the last 4 years | No public funds accessed; no qualifying immigration breach |
| 5 Years | Strong contribution (High earners, Public Service, British connection) | £50,271+ in 3 of the last 5 years, OR 5 years in an eligible public service job | No public funds accessed; no qualifying immigration breach |
| 10 Years | Standard default pathway for compliant migrants | £12,571+ in 5 of the last 7 years | No public funds accessed; no qualifying immigration breach |
| 20 Years | Migrants with past non-compliance or public funds use | £12,571+ in 5 of the last 7 years | Applies where breaches block earlier pathways |
Three Ways to Qualify for the 5-Year Pathway
- Higher Earnings (£50,271+): You must earn at least £50,271 in three of the five years immediately before applying. Note that the current Skilled Worker general salary threshold is £41,700 (£8,571 below the 5-year settlement test). A Skilled Worker paid strictly at the general threshold every year will default to the 10-year route unless eligible under another category.
- Public Service Occupations (Annex C): Eligible workers in specified health and education roles—including doctors, nurses, teachers, and social workers paid on national pay scales—qualify after 5 years without needing to meet the £50,271 threshold.
- British Connection: Eligible partners, parents, and children of British citizens, alongside Commonwealth citizens on the UK Ancestry route.
How Earnings Are Assessed: The "Best Years" Rule
To prevent maternity leave, parental leave, caring responsibilities, or temporary illness from pushing applicants onto a longer pathway, the Home Office assesses income using a "best years" approach:
- 3-Year Pathway: £125,141+ in 3 of the last 4 years (1 year can fall below).
- 5-Year Pathway: £50,271+ in 3 of the last 5 years (2 years can fall below).
- 10-Year Pathway: £12,571+ in 5 of the last 7 years (2 years can fall below).
All three thresholds are indexed directly to UK income tax bands (£12,571 basic rate, £50,271 higher rate, £125,141 additional rate) and will rise automatically in line with future tax threshold changes.
Worked Examples
- Scenario A (Qualifies in 5 Years): A Skilled Worker earns £52,000, £54,000, and £51,000 across three years, and £44,000 and £46,000 in the other two years. Because three of the five years meet or exceed £50,271, the 5-year test is met.
- Scenario B (Defaults to 10 Years): A colleague in a non-Annex C role earns between £44,000 and £48,000 across all five years. Because they never cross £50,271, they do not meet the 5-year test, but they comfortably pass the £12,571 threshold and qualify via the 10-year pathway.
Workers Below RQF Level 6 & The Pre-April 2024 Cohort
- Below RQF Level 6: Workers in occupations below RQF Level 6 will not face the 15-year wait floated in the initial consultation; they fall under the standard 10-year pathway.
- Pre-April 2024 Transitional Cohort: Skilled Worker salary thresholds rose sharply in April 2024 with transitional arrangements originally due to expire in 2030. Because the qualifying period for many of these workers is now 10 years, the Government has extended transitional salary protections until 2035.
- Health & Education Support Roles: Nursing auxiliaries, teaching assistants, and care workers below RQF Level 6 on national pay scales (or earning £25,000+ in care) who arrived before the May 2025 White Paper retain a one-off 5-year settlement route.
Partners and Children
- Arriving Together: A dependant partner who arrives with the main applicant can settle at the same time, provided they meet the relevant criteria.
- Combined Household Income: Eligible couples can combine earnings to meet the minimum economic contribution test using a household threshold of £25,142 (twice the £12,571 individual figure).
- Children Under 18: Settle alongside their parents and are exempt from the income, debt, English language, and Life in the UK requirements (though suitability and criminality checks still apply).
Mandatory Minimum Standards for All Applicants
Higher earnings or public service cannot offset the four mandatory baseline requirements:
- Spotless Criminality & Suitability Record: Any adult with a UK criminal record—including custodial or suspended sentences, court-imposed fines, community sentences, or out-of-court disposals (conditional cautions/discharges)—will be refused settlement.
- Zero Government Debt: No outstanding NHS charges, HMRC tax or National Insurance arrears, or Home Office litigation debt.
- English at Level B2: Raised from B1 to CEFR Level B2 (A-Level equivalent), with exemptions for children, those aged 65+, and applicants with qualifying physical or mental conditions.
- Life in the UK Test: Mandatory pass required.
- Sustained Contribution: Continued compliance with visa terms and lawful status.
What the Home Office Expects
Its illustrative forecast for settlement between 2026 and 2030 puts 27,000 Skilled Workers (and 17,000 dependants) on the three-year pathway, 86,000 (52,000) on five years, and 146,000 (85,000) on ten. These are Home Office estimates, not entitlements.
